Waived Filing Fee for Veterans Disability Application

Did you know your filing fee for Veterans Disability benefits can be waived if you meet certain parameters?

According to the United States Court of Appeals for Veterans Claims Rule 3(f) (Payment of Fees) or Rule 21(a) (Petition: Service, Content, and Filing), your filing fee can be waived provided you declare financial hardship and have the documentation to support your declaration if the Court wishes to see more information.

Please be aware that the Court has the right to request your financial documentation, and that signing this declaration can lead to perjury pursuant to 28 U.S.C. § 1746 if you’re not forthcoming and honest about your situation.

You can declare financial hardship by filling out Form 4 in the Appendix of Forms at www.uscourts.cavc.gov. If the form is incomplete or deemed insufficient by the VA, it will be returned to you. In this case, you will either end up paying the filing fee or be asked to resubmit your declaration with the necessary corrections.
